Data processing in accordance with Art. 13 GDPR

Below we inform you how we process your data and what rights you are entitled to under the data protection regulations.

3.Purposes of the processing of personal data and legal basis

 

In order to fulfil our contracts with you, to execute your orders and/or to carry out measures and activities in the context of pre-contractual relationships with you (contractual relationship with you), we process the following data in particular:

 

  • Master data of contact persons, e.g. title, first name, surname

  • Contact details, e.g. e-mail addresses, address, telephone numbers, fax numbers

  • Other information that is necessary for the performance of the contractual relationship or that you provide voluntarily.

 

We process your personal data in particular for the following purposes:

 

  • to identify you as our contractual partner

  • for correspondence with you

  • to plan, implement and manage the contractual relationship with you

  • for the verifiability of transactions, orders and other agreements

  • for cost recording, controlling and reporting

  • if necessary, to conduct surveys, marketing campaigns, market analyses or similar activities (events)

  • if necessary, to conduct the business relationship / contractual relationship with other business partners / contractual partners of ours

  • if necessary for external evaluation by the Chemnitz University of Technology (TU Chemnitz)

  • if necessary for the assertion of legal claims and for defence in legal disputes

  • if necessary for the prevention and investigation of criminal offences

  • for compliance with legal requirements, e.g. retention obligations under tax and commercial law

 

The processing of your personal data takes place on the basis of

 

  • art. 6 para. 1 lit. b) GDPR, fulfilment of a contract or implementation of pre-contractual measures with you

  • art. 6 para. 1 lit. c) GDPR, fulfilment of a legal obligation to which we are subject

  • art. 6 para. 1 lit. f) GDPR, for the protection of our legitimate interests.

 

Our legitimate interest lies in the proper initiation, execution and fulfilment of the contractual relationship.

 

4.Recipients of personal data

 

We may transfer your personal data to

 

  • public authorities that receive or must receive data due to legal regulations

  • other business partners / contractual partners of ours, if applicable

  • tU Chemnitz, if applicable

  • Legal advisors if this is necessary for compliance with applicable law or for the assertion, exercise or defence of legal claims

  • external service companies in their activities as processors (e.g. data destruction) in order to process data with their products and services

  • external service providers in their capacity as data processors who process data for us as data processors (e.g. courier services, credit institutions).


5. Storage period of your personal data

 

Your personal data will be processed until the end of 2027, unless their (temporary) further processing is contractually necessary and for the fulfilment of the purposes listed under 3. for a predominantly legitimate interest.

 

In addition, we only process your personal data to the extent and insofar as we are obliged to do so due to mandatory legal, e.g. commercial or tax law storage and documentation obligations


6. Your rights

 

According to Art. 15 ff. GDPR, you have the right to information, rectification, erasure, restriction of processing or objection to the processing of your personal data as well as the right to data portability.

 

You also have the right to lodge a complaint with the competent data supervisory authority in accordance with Art. 77 GDPR.

 

To exercise your rights, please contact the controller named under 1. or the data protection officer listed under 2. in writing, if possible.

 

7.Processing of your personal data as part of the evaluation of the European Capital of Culture Chemnitz 2025 project

8.Obligation to provide personal data

 

In order to execute our contracts with you, to execute your orders and/or to carry out measures and activities in the context of pre-contractual relationships with you (contractual relationship with you), you must provide the personal data that is necessary for this and for the fulfilment of the associated obligations. Without this data, we will generally have to reject or terminate the contractual relationship with you or will no longer be able to fulfil it.

 

9.Automated decision-making

 

Automated decision-making does not take place.
