Data protection information for contractual partners in the context of the GELEBTE NACHBARSCHAFT project

Data processing in accordance with Art. 13 GDPR

The GELEBTE NACHBARSCHAFT project works with institutions, educational organisations, associations and other stakeholders to develop a forward-looking urban space design. At the heart of the concept are jointly planned and implemented planting campaigns that include educational programmes and artistic activities. The GELEBTE NACHBARSCHAFT project cooperates with landowners and maintenance partners to organise and implement the planting campaigns. The partner constellations are very diverse, so private individuals, institutions, educational organisations, associations and other stakeholders can be either landowners, care partners or both.

 

Below we inform you - our project partners - how we process your data and what rights you are entitled to under data protection regulations.

We process the following data in order to carry out our projects with you

- Venues

- Associated events and event dates

We also process the following information from the landowners

- District/parcel (e.g. embedded in a site plan)

- Land register extract

 

We process your personal data in particular for the following purposes

- to identify you as our project partner

- for correspondence with you

- for the planning, implementation and management of projects / the project relationship with you

- for the verifiability of transactions, orders and other agreements

- for cost recording, controlling and reporting

- for invitations to other planting campaigns and events organised by other projects of the person responsible

- for external evaluation by Chemnitz University of Technology (TU Chemnitz) - contact with the aim of disseminating information regarding the evaluation (sending surveys, invitations to interviews and focus group discussions and team coordination, notifications of further training or other offers in the field of evaluation), creation of profiles for the purpose of pre-selecting projects for certain data collection methods

- for the assertion of legal claims and defence in legal disputes

- for compliance with legal requirements

 

The processing of your personal data takes place on the basis of

 

  • Point (b) of the first subparagraph of Article 6(1) GDPR for the fulfilment of a contract or the implementation of pre-contractual measures with you
  • point (c) of the first subparagraph of Article 6(1) GDPR for compliance with a legal obligation to which we are subject
  • point (f) of the first subparagraph of Article 6(1) GDPR to safeguard our legitimate interests; our legitimate interest lies in the proper initiation, implementation and handling of the project relationship

 

The transfer of your personal data to Chemnitz University of Technology, which is commissioned with the external evaluation of Chemnitz 2025, is based on joint responsibility in accordance with Article 26 GDPR.

 

4.Recipients of personal data

 

We may transfer your personal data to

 

  • public bodies that receive or must receive data due to legal regulations
  • the TU Chemnitz
  • other project partners of ours for the purpose of cooperation and networking
  • Legal advisors if this is necessary for compliance with applicable law or for the assertion, exercise or defence of legal claims
  • external service companies in their activities as processors (e.g. data destruction) in order to process data with their products and services
  • external service providers in their role as function providers who process data for us (e.g. courier services).
  • Communication of location data for event information to the press and public
  • Location data of planted trees for presentation on a site plan

 

5.Storage period of your personal data

 

Your personal data will be processed until at least the end of 2036 due to our duty of care for the planted trees, and until 2045 if the project is extended.

 

Beyond this, we will only process your personal data to the extent and insofar as we are obliged to do so due to mandatory statutory retention and documentation obligations, e.g. under commercial or tax law

 

 

6.Your rights

 

In accordance with Article 15 et seq. GDPR, you have the right to information, rectification, erasure, restriction of processing or objection to the processing of your personal data as well as the right to data portability.

 

If personal data is processed on the basis of your consent in accordance with Article 6(1)(a) GDPR, you can withdraw your consent at any time.

 

You also have the right to lodge a complaint with the competent data supervisory authority in accordance with Article 77 GDPR.

 

To exercise your rights, please contact the controller named under 1. or the data protection officer listed under 2. in writing, if possible.

 

7.Obligation to provide personal data

 

In order to carry out our projects with you (project relationship with you), you must provide the personal data required for this and for the fulfilment of the associated obligations. Without this data, we will generally have to reject or terminate the project relationship with you or no longer carry it out.

 

8.Automated decision-making

 

Automated decision-making does not take place.
